<br /> <br /> <br /> <br /> <br /> <br /> must also be eligible for, and in fact be appointed as a reserve police officer of the City <br /> under the provisions of California Penal code section 830.6(a)(2). <br /> <br /> Other than as identified above, the compensation for the position of Police <br /> Commissioner shall be provided for by Resolution of the City Council. <br /> The Police Commissioner shall be appointed by a majority of the City <br /> Council. <br /> <br /> Section 3. Peace Officer Status. <br /> <br /> Pursuant to the provisions of California Penal Code section 830.6(a)(2), a qualified <br /> person appointed as a reserve police officer with the City who occupies the position of <br /> Police Commissioner shall be deemed to be a peace officer with all or the powers and <br /> duties as afforded under said Penal Code section. <br /> <br /> <br /> Section 4. Duration. <br /> <br /> This ordinance shall remain in effect for a period of five years from the adoption <br /> date, and as of that date is repealed unless a City Council adopts a further ordinance of <br /> resolution to extend or delete that sunset date. <br /> <br /> Section 5. Ordinance to Operate Exclusively. <br /> <br /> Except as set forth in this ordinance, all other provisions of the Code shall remain in <br /> full force and effect. <br /> <br /> Section 6. Severability. <br /> <br /> If any section, subsection, sentence, clause, phrase or portion of this ordinance is <br /> for any reason held to be invalid or unconstitutional by the decision of any court of <br /> competent jurisdiction, such decision shall not affect the validity of the remaining portions of <br /> this ordinance. The City Council of the City of Santa Ana hereby declares that it would <br /> have adopted this ordinance and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or more sections, subsections, <br /> sentences, clauses, phrases, or portions be declared invalid or unconstitutional. <br /> <br /> <br /> <br /> <br /> ADOPTED this day of , 2012. <br /> <br /> <br /> <br /> Ordinance No. NS-XXX <br /> Page 3 of 4 <br /> <br /> <br /> 5OA-17 <br />
