ARTICLE XIV <br />14.0 RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br />During the term of this Agreement, the City agrees to grant full-time release from duty for one (1) <br />Association representative for the conduct of Association affairs subject to the following: <br />14.1 The Association shall reimburse the City for one hundred percent (100%) of salary (including <br />any salary additives, such as career incentive pay) and benefit costs. Such reimbursement <br />maybe from the bank established pursuant to Section 8.15 of Article VIII of this Agreement. <br />14.2 The Association shall provide an insurance policy or policies, or certificate of such <br />insurance, naming the City of Santa Ana, its officers, employees and agents as insured or <br />additional insured, which provides coverage against liability for any and all claims and/or <br />suits for damages or injuries to persons or property resulting from or arising out of any actor <br />omission of said Association representative. Said policy or policies of insurance shall provide <br />coverage for both bodily injury and property damage in not less than the following minimum <br />amounts: One million dollars ($1,000,000.00) combined single limit or its equivalent. Said <br />policy or policies shall also contain a provision that no termination, cancellation or change of <br />coverage of insured or additional insured shall be effective until thirty (30) days notice <br />thereof has been given in writing to the City of Santa Ana. <br />14.3 The Association shall provide the City of Santa Ana with an insurance certificate from a <br />workers' compensation insurance carrier certifying that it carries primary workers' <br />compensation insurance on behalf of said Association representative and the policy shall not <br />be cancelled nor the coverage reduced except upon ten (10) days' prior notice to the City of <br />Santa Ana. <br />14.4 The Association shall indemnify and save harmless the City of Santa Ana, its officers and <br />employees, from and against any and all damage to property or injuries to or death of any <br />person or persons, including property and employees or agents of the City of Santa Ana, and <br />shall defend, indemnify and save harmless the City of Santa Ana, its officers and employees, <br />from any and all claims, demands, suits, actions or proceedings of any kind or nature, <br />including, but not by way of limitation, workers' compensation claims, resulting from or <br />arising out of the negligent acts, errors, or omissions, or arising out of the intentional or <br />malicious acts of Association's representative. <br />14.5 The Association and the City of Santa Ana agree that the Association's representative will <br />not be required to carry out any peace officer's duties during such time that the Association's <br />representative is on such full-time release from duty. The Association's representative will be <br />required to comply with the Rules and Regulations of the Santa Ana Police Department as <br />they apply tooff--duty employees, except such representative will not be required to report for <br />duty for any purpose. <br />14.6 Upon return to duty from such full-time release, the Association's representative shall be <br />restored to the same position without loss of any benefits as he or she would have occupied <br />or accrued if there had been no disruption in duty status. <br />55 <br />
