must also be eligible for, and in fact be appointed as a reserve police officer of the City <br />under the provisions of California Penal code section 830.6(a)(2). <br />Other than as identified above, the compensation for the position of Police <br />Commissioner shall be provided for by Resolution of the City Council. <br />The Police Commissioner shall be appointed by a majority of the City <br />Council. <br />Section 3. Peace Officer Status. <br />Pursuant to the provisions of California Penal Code section 830.6(a)(2), a qualified <br />person appointed as a reserve police officer with the City who occupies the position of <br />Police Commissioner shall be deemed to be a peace officer with all or the powers and <br />duties as afforded under said Penal Code section. <br />Section 4. Duration. <br />This ordinance shall remain in effect for a period of five years from the adoption <br />date, and as of that date is repealed unless a City Council adopts a further ordinance of <br />resolution to extend or delete that sunset date. <br />Section 5. Ordinance to Operate Exclusively. <br />Except as set forth in this ordinance, all other provisions of the Code shall remain in <br />full force and effect. <br />Section 6. Severability. <br />If any section, subsection, sentence, clause, phrase or portion of this ordinance is <br />for any reason held to be invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana hereby declares that it would <br />have adopted this ordinance and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or more sections, subsections, <br />sentences, clauses, phrases, or portions be declared invalid or unconstitutional. <br />ADOPTED this 4th day of June, 2012. <br />Ordinance No. NS-XXX <br />Page 3 of 4 <br />11 B-3
