EXHIBIT 1 <br />ORDINANCE NO. NS-XXX <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING SECTION 39-24 OF THE <br />SANTA ANA MUNICIPAL CODE TO AUTHORIZE THE <br />SETTING OF WATER METER TEST FEE BY <br />RESOLUTION OF THE CITY COUNCIL <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br />Section 1. The City Council hereby finds, determines and declares as follows: <br />A. The Santa Ana Department of Public Works provides metered rate water <br />service for customers within the city limits; and <br />B. A customer receiving water from the municipal water system (hereinafter, <br />"the Utility") may request the Utility to test the water meter serving its <br />premises for accuracy after depositing $5.00 to pay the costs associated <br />with providing the test; and <br />C. The City Council has adopted a policy requiring that the cost of providing <br />services should be borne by the person requesting such services; and <br />D. The Department of Public Works has recommended that the water meter <br />test fee be increased to pay the actual costs associated with providing <br />such test, including personnel costs of travelling to the premises, pulling <br />the meter, testing the meter and reinstalling the meter; and <br />E. The costs associated with providing services may increase annually, and <br />the cost to the City of providing the water meter test will increase in a like <br />amount, thus the water meter test fee should be annually adjusted <br />equivalent to the annual average of the Consumer Price Index, Los <br />Angeles-Riverside-Orange County area; and <br />F. All fees assessed for the water meter test bear a direct correlation <br />between the amount of the fee and the actual cost of the services <br />provided, including administration, personnel and implementation services <br />specifically related to water meter test. Further, the proposed increase will <br />not result in revenue which exceeds the City's estimated reasonable costs <br />to provide the water meter test. <br />5OA-3
