Set Public Hearing For_ <br />C <br />CITY MANA R <br />CONTINUED TO <br />FILE NUMBER <br />RECOMMENDED ACTION <br />Authorize the City Manager and Clerk of the Council to execute a quitclaim deed relinquishing the City's <br />interest in a storm drain easement at 1500 South Auto Mall Drive to Penske Automotive Group Santa <br />Ana B1, Inc., a Delaware Corporation. <br />DISCUSSION <br />In 2003, Crevier BMW proposed the expansion of its dealership at 1500 South Auto Mall Drive. In 2006, <br />a City-owned-and-maintained 27-inch storm drain pipe was abandoned to eliminate a conflict with one of <br />Crevier's planned structures. The abandoned pipe was replaced with the construction of a 30-inch storm <br />drain pipe at a new location within the property. A 20-foot-wide easement has been dedicated to the <br />City for the new pipe location. Therefore, the existing 10-foot-wide easement for the abandoned pipe <br />can be quitclaimed (Exhibit 1). PAG Santa Ana B1, Inc. (Penske) acquired the dealership property, <br />although the Crevier BMW name remains. Penske is in the site plan review process with the City for an <br />expansion of the service bay in the proximity of the easement to be quitclaimed. <br />ENVIRONMENTAL IMPACT <br />In accordance with the California Environmental Quality Act, the proposed request is not considered to <br />be a project.
