Agreements with County of Orange <br />For Newport Bay TMDL Compliance <br />June 18, 2012 <br />Page 2 <br />involved, of which 10.77 percent pertains to the City with a not-to-exceed amount of $175,000 for <br />fiscal year 2012-13. <br />The second agreement, D12-030, focuses on the TMDL for selenium, which is a naturally <br />occurring element that is toxic to aquatic life and birds when concentrations are excessive. To <br />meet the selenium TMDL requirements, staff is developing a feasibility study indicating reasonable <br />methods of compliance, including reduction of irrigation and low-flow diversion into the sanitary <br />sewer system from the city's tributaries discharging into Newport Bay. This agreement provides <br />reimbursement for all costs to the City for developing the alternative feasibility report to comply with <br />the selenium TMDL compliance requirements.
