(Page 3 of 61) <br />i <br />83-430388 <br />The easement qranted herein shall constitute a bindincr <br />servitude upon the Premises, and Grantor convenants on behalf <br />of its successors and assiqns, with Grantee, its successors <br />and assigns, such covenants beinq deemed to run as a bindinq <br />servitude, in ocrnetuity, with the land, to do or refrain from <br />doing upon the Premises each of the following stipulations, <br />which the%, agree contribute to the public puroose in that they <br />aid significantly in the preservation of the historic property: <br />1. The exterior surfaces of the improvements (including, <br />without limitation, the exterior walls, roofs, chimneys and other <br />elements of the exterior facade thereof) are those which are <br />visible at the Present time, which are those depicted in the <br />photographs attached hereto and incorporated herein as Exhibit <br />A hereof. Without the express written nermission of the Grantee, <br />its successors or assigns, no construction, alteration or remodelinn <br />shall be undertaken or permitted to be undertaken on the Premises <br />which would affect either the exterior surface or otherwise alter <br />the facade or appearance of said improvements as depicted in Exhibit <br />A or which would adversely affect the structural soundness of the <br />Premises; <br />Provided, however, that the reconstruction, repair, <br />repainting or refinishing of the presently existing parts or <br />elements of the said improvements subject to this architectural <br />facade easement, damaqe to which is resulted from casualty loss, <br />deterioration or wear or tear, shall be permitted without the <br />prior approval of Grantee, provided that such reconstruction, <br />repair, repainting or refinishing is performed in a manner which <br />will not alter the appearance of those elements of the improvements <br />Document:198300430388 Page:3 of 20 <br />65A-71
