13. LIQUIDATED DAMAGES <br />If City determines that the Contractor has breached its promise to provide parking control <br />enforcement services in compliance with the Terms and Conditions of applicable laws and <br />regulations, or the specifications set forth herein, it would be impracticable and extremely <br />difficult to determine the damage to City arising from such breach. Therefore, in the event of <br />Contractor's breach, Contractor shall pay to City the sum of $125.00 per hour per occurrence for <br />such breach per parking control personnel, in addition to any cost, fines, etc. levied against the <br />City. <br />14. EMPLOYMENT OPPORTUNITIES FOR SANTA ANA RESIDENTS <br />Contractor shall solicit and advertise employment opportunities to Santa Ana residents. <br />The City shall inform the Contractor of areas to publicize recruitment opportunities, such as work <br />centers and community centers. Such effort and procedure will be provided to the City for review. <br />15. EMPLOYMENT OF DISPLACED SANTA ANA WORKFORCE <br />Contractor shall extend offers of employment to any displaced City of Santa Ana parking <br />control officer (PCO) meeting Contractor's minimum hiring standards for a minimum of one year <br />and at a rate commensurate to their last base salary amount as a parking control officer, as set <br />forth in Exhibit C to this Agreement. Thereafter, the Contractor may pay according to the <br />Contractor's normal pay structure. <br />16. CONTRACTOR COMMUNITY EVENT PARTICIPATION AND PUBLIC <br />AWARENESS <br />If requested by City, Contractor shall participate in extensive public awareness efforts <br />and community events and programs, such as neighborhood and City events. Such participation <br />shall be upon City request provided with reasonable notice of event timing. Such events will not <br />exceed four (4) per year. <br />17. COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS <br />a. Contractor shall perform all requirements under this contract in strict observance of <br />and in compliance with all applicable environmental, traffic, safety and any other applicable laws, <br />regulations, ordinances, codes and any other legislative or statutory requirements. <br />b. Contractor warrants that the performance of services under this contract shall be <br />compliant with the current requirements of the Occupational Safety and Health Act (OSHA) and <br />as it may be amended or updated throughout the term of this contract. <br />c. Contractor shall be liable for all violation and/or fines levied against the City by <br />Federal, State and/or local agencies for any and all violations including, but not limited to, oil or <br />fluid leaks. <br />18. DISCRIMINATION <br />Contractor shall not discriminate because of race, color, creed, religion, sex, marital <br />status, sexual orientation, age, national origin, ancestry, or disability, as defined and prohibited by <br />applicable law, in the recruitment, selection, training, utilization, promotion, termination or other <br />25F-12
