aIUL 16 2018 N- 2010 - 023 -002 <br />o � s,4'� p C2� <br />LoY'� f3rav�n <br />�G\,r�' �ECOND AMENDMENT TO MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF SANTA ANA AND THE <br />SANTA ANA UNIFIED SCHOOL DISTRICT REGARDING SCHOOL <br />DISTRICT CHIEF OF SCHOOL POLICE SERVICES <br />THIS SECOND AMENDMENT TO MEMORANDUM OF UNDERSTANDING is <br />entered into on June 12 � 2012, by and between the Santa Ana Unified <br />School District (hereinafter referred to as the "District ") and the City of Santa Ana (hereinafter <br />referred to as the "City "). <br />RECITALS: <br />A. District and City entered into said Memorandum of Understanding No. N -201 0 -023, dated <br />February 23, 201 O (hereinafter "said MOU ") under which the City, by and through the Santa <br />Ana Police Department Chief of Police, assigned a City Police Lieutenant to perform the <br />services of a District Chief of School Police Services for the District's school police <br />program <br />B. District and City entered into First Amendment to Agreement No. N -201 0 - 023 -001, dated <br />February 22, 201 1, under which the parties agreed to extend the duration of said MOU for an <br />additional one -year period. <br />C. In accordance with the terms and conditions of said MOU, City and District (hereinafter "the <br />parties ") wish to amend the termination provision to a period of ninety (90) days and extend <br />the term of said MOU from February 23, 2012 through June 30, 2015. <br />WHEREFORE, in consideration of the covenants contained in said MOU, and subject to all the <br />terms and conditions of said MOU, except those amended in this Second Amendment to said <br />MOU, the parties agree as follows: <br />1. Section 3, DURATION, shall be amended to extend the duration of said MOU from February <br />23, 2012 through June 30, 20l 5. In order to provide continuous uninterrupted service, all <br />services provided by City since February 23, 2012, shall be included within the scope of <br />agreement_ All other conditions set forth in Section 3 of said MOU shall remain in full force <br />and effect. <br />2. Section 4, TERMINATION, shall be amended to provide for ninety (90) days written notice <br />of termination, such that it reads as follows: <br />"At any time either party may terminate the MOU, without cause, by giving ninety (90) <br />days written notice to the other party. In the event of termination, the City shall be paid <br />its compensation due as of the effective date of the termination. <br />
