SECOND AMENDMENT TO AGREEMENT <br />A- 2009 - 113 -02 <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into on January 25, 2012, <br />by and between Bell Building Maintenance, Inc., a California corporation ( "Contractor ") and the <br />City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California ( "City "). <br />RECITALS: <br />A. The parties entered into that certain Agreement A- 2009-113, dated August 3, 2009, <br />(hereinafter "said Agreement ") by which Contractor has provided janitorial maintenance <br />services at Santa Ana City Hall, Ross Annex and Corporate Yard. <br />Fs. City facilities will be closed every Friday commencing January 1, 2012 which will result in a <br />reduction of janitorial service required to maintain those City facilities. <br />C. As a result of City maintenance staff reductions Contractor has been asked to and has agreed <br />to provide janitorial maintenance for additional space in City Hall. <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to amend the <br />Scope of Services to reflect fewer days of service provided and include additional floor space <br />that will be cleaned by Contractor on the reduced service schedule. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Second Amendment to <br />Agreement, the parties agree as follows: <br />1. Section 1, SCOPE OF SERVICES, shall be amended to provide that janitorial maintenance <br />services will be provided at City Hall and Ross Annex four days per week, as follows: <br />Commencing January 1, 2012 Contractor shall perform janitorial maintenance services at City <br />Hall, Ross Annex and the Corporate Yard four days per week, Monday through Thursday. Daily <br />maintenance tasks set forth in Exhibit A shall be performed four days per weeks. Tasks performed <br />on other than a daily schedule shall not be affected by the reduced weekly schedule. <br />Cominencini February 21, 2012, Contractor shall provide janitorial maintenance services on the <br />4' ", 5'" and 6` floors of City Hall in conformance with the specifications for Ross Annex and the <br />City Hall basement as set forth above. <br />Contractor shall remove and dispose of expended fluorescent lamps in full compliance with the <br />California hazardous waste disposal rules and regulations. <br />2. Section 2.a., COMPENSATION, shall be amended to reflect an annual savings of $19,644 due to <br />the reduced service days-per week, and an annual increase of $23,400 for the maintenance of <br />additional floor space, for a total annual increase of $3,746.00. The total amount to be expended <br />on janitorial services and supplies for City facilities shall not exceed $231,906, annually, during <br />the term of this Agreement. <br />
