THIS FIFTH AMENDMENT TO AGREEMENT is entered into on June 27, 2012, b ?o,vie\l Y (?e?id0 and between ARC MID-CITIES -ORANGE COUNTY ("Contractor") and the City of Santa Ana ("City"). RECITALS: A. The parties entered into Agreement #N-2007-070, dated May ] , 2007, (hereinafter "said Agreement") by which Consultant has provided personnel, materials and supervision for graffiti removal services. B. In accordance with the terms and conditions of said Agreement, the parties wish to extend the term for an additional one-year period and provide compensation for services during that extended term. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Fifth Amendment to Agreement, the parties agree as follows: 1. Section 2, COMPENSATION, shall be amended to add compensation of $16,200 to pay for services during the FY 2012-2013 fiscal year, at the rate of $1,350.00 per month. 2. Section 3, TERM, shall be amended to extend the termination date an additional year, through June 30, 2013. 3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect.
