• Expressed concerns regarding the Clerk of the Council's opinion <br />relative to Measure D as received from outside legal counsel; rejected <br />alternate opinion submitted by Mr. Madrid in May, 2012. <br />Councilmember Martinez: <br />• Would not tolerate discourse towards staff. <br />Councilmember Benavides: <br />• Indicated that legal opinion by outside Counsel was sought to receive <br />impartial review and analysis of the matter; requested that same <br />consideration of forbidding dire conduct of officials apply to staff as <br />well. <br />Councilmember Sarmiento: <br />• Agreed that Measure D has to be addressed by the courts; special <br />counsel hired due to constitutional rights question being posed by the <br />lawsuit; and <br />• Opposed to Councilmembers tactless demeanor towards staff; civility <br />important to avoid hostile work environment. <br />Councilmember Tinajero: <br />• Opined that staff evaluations should be addressed in Closed Session; <br />Council should be held to same standards as public. <br />Mayor Pulido: <br />• Noted he has no position on Measure D; City has duty and obligation <br />to represent the Clerk of the Council when sued; need quick resolution; <br />• Urged all members to treat all with respect and self-police. <br />Mayor Pro Tern Alvarez: <br />• Conveyed dissatisfaction with Clerk of the Council; disagrees with <br />notice received relative to hostile work environment. <br />ADJOURNED- 10:28 P.M. - The next meeting of the City Council is scheduled for <br />Monday, August 6, 2012 at 5:00 p.m. for the Closed Session <br />Meeting immediately followed by the Regular Open Business <br />Meeting at 5:45 p.m. in the Council Chamber, 22 Civic Center <br />Plaza, Santa Ana, California. <br />Adjourn in memory of <br />Osmara Meza and Mike Sokolski <br />Maria D.
