IfVSURANCE N07 ON FILE <br />WORK MAY NOT PROCEED N-2012-os7 <br />CLERK OF COUNCIL <br />DATE: AUG 1 0 2012 <br />0 _ 'PW/.? ? p??0,1(1 NON-EXCLUSNE LICENSE AGREEMENT <br />Mindy ?y <br />THIS LICENSE AGREEMENT ("Agreement') is made and entered into on g- / - /.2 by and <br />between the City of Santa Ana, a charter city and municipal corporation organized and existing <br />under the Constihrtion and laws of the State of Califomia (the "LICENSOR°) and PAR Electrical <br />Contractors, ("LICENSEES with respect to the following: <br />1. ACKNOWLEDGEMENTS <br />A_ LICENSOR owns the vacant lot identified as APN#004-123-52, located on the northwest <br />comer of Bristol Street and Civic Center Drive, Santa Ana, Califomia_ LICENSOR <br />desires to license use of said License Area to LICENSEE- <br />B. LICENSEE represents that it desires to utilize the License Area for construction staging <br />for the installation of new power poles along Bristol Street on behalf of Southern <br />Califomia Edison_ <br />2. GRANT OF LICENSE <br />a_ LICENSOR grants to LICENSEE a personal, non-exclusive, revocable license <br />("License°) to encroach upon the License Area as hereinabove described and shown in <br />general in Exhibit "A°, attached hereto and incorporated by this reference, for its use as <br />a storage area for construction material and equipment. <br />b_ LICENSEE may not encroach upon the License Area for any other purpose or business <br />without obtaining LICENSOR's prior written consent. <br />c. LICENSOR shall not be responsible for loss of or damage to, any personal property left <br />on the License Area, or improvement made by LICENSEE in the License Area_ <br />d. This License is made subject and subordinate to the prior and continuing right of <br />LICENSOR to use the property or the use of the public right of way. <br />3. DUTIES OF LICENSEE <br />a. In exercising these rights, LICENSEE shalt use reasonable care and may not <br />unreasonably increase the burden on the License Area. LICENSEE agrees that any use <br />it makes of the License Area as specified herein shall be affected with all reasonable <br />diligence and precaution to avoid damage to the land, property or personnel- <br />b. LICENSEE agrees to conform to any reasonable requirements set forth by LICENSOR, <br />related to the use of the License Area as a storage area during the course of this <br />License_ <br />c_ LICENSEE will install green screening on the chain link fence and sandbags around the <br />property. Ingress and egress must be off Civic Center Drive. Supplies cannot be <br />stacked above 6-feet high. LICENSEE shall make no other improvements or installation <br />to the License Area without the written approval of the LICENSOR. LICENSEE agrees <br />to pay all the costs of the installation, operation, maintenance, repair and removal of any <br />improvements in the License Area.
