IfVSURANCE N07 ON FILE WORK MAY NOT PROCEED N-2012-os7 CLERK OF COUNCIL DATE: AUG 1 0 2012 0 _ 'PW/.? ? p??0,1(1 NON-EXCLUSNE LICENSE AGREEMENT Mindy ?y THIS LICENSE AGREEMENT ("Agreement') is made and entered into on g- / - /.2 by and between the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constihrtion and laws of the State of Califomia (the "LICENSOR°) and PAR Electrical Contractors, ("LICENSEES with respect to the following: 1. ACKNOWLEDGEMENTS A_ LICENSOR owns the vacant lot identified as APN#004-123-52, located on the northwest comer of Bristol Street and Civic Center Drive, Santa Ana, Califomia_ LICENSOR desires to license use of said License Area to LICENSEE- B. LICENSEE represents that it desires to utilize the License Area for construction staging for the installation of new power poles along Bristol Street on behalf of Southern Califomia Edison_ 2. GRANT OF LICENSE a_ LICENSOR grants to LICENSEE a personal, non-exclusive, revocable license ("License°) to encroach upon the License Area as hereinabove described and shown in general in Exhibit "A°, attached hereto and incorporated by this reference, for its use as a storage area for construction material and equipment. b_ LICENSEE may not encroach upon the License Area for any other purpose or business without obtaining LICENSOR's prior written consent. c. LICENSOR shall not be responsible for loss of or damage to, any personal property left on the License Area, or improvement made by LICENSEE in the License Area_ d. This License is made subject and subordinate to the prior and continuing right of LICENSOR to use the property or the use of the public right of way. 3. DUTIES OF LICENSEE a. In exercising these rights, LICENSEE shalt use reasonable care and may not unreasonably increase the burden on the License Area. LICENSEE agrees that any use it makes of the License Area as specified herein shall be affected with all reasonable diligence and precaution to avoid damage to the land, property or personnel- b. LICENSEE agrees to conform to any reasonable requirements set forth by LICENSOR, related to the use of the License Area as a storage area during the course of this License_ c_ LICENSEE will install green screening on the chain link fence and sandbags around the property. Ingress and egress must be off Civic Center Drive. Supplies cannot be stacked above 6-feet high. LICENSEE shall make no other improvements or installation to the License Area without the written approval of the LICENSOR. LICENSEE agrees to pay all the costs of the installation, operation, maintenance, repair and removal of any improvements in the License Area.
