REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />SEPTEMBER 4, 2012 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2012 -17 <br />AND VARIANCE NO. 2012 -06 TO ALLOW <br />THE ACADEMY CHARTER HIGH SCHOOL <br />AT 1901 NORTH FAIRVIEW STREET - <br />ORANGEWOOD CHILDRENS FOUNDATION, <br />APPLICANT <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />P---tiV <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1s` Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2012 -17 as conditioned <br />and Variance No. 2012 -06 as conditioned. <br />PLANNING COMMISSION ACTION <br />On August 13, 2012, the Planning Commission adopted a resolution approving the Mitigated <br />Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 2011 -74; <br />Conditional Use Permit No. 2012 -17 as conditioned; Variance No. 2012 -06 (a) as conditioned to <br />allow a reduction in required parking for the high school; Variance No. 2012 -06 (b) as conditioned <br />to exceed the allowable building height; and Variance No. 2012 -06 (c) as conditioned to exceed <br />the allowable fence height by a vote of 6:0 (Turner absent) to allow The Academy Charter High <br />School located at 1901 North Fairview Street in the Professional (P) zoning district. The Planning <br />Commission made no changes to the recommended conditions of approval outlined in the <br />attached staff report (Exhibit A). <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />J M.
