<br />Construction Permit, which requires the development and implementation of a Storm Water
<br />Pollution Prevention Plan ( SWPPP). The SWPPP identifies pollutants that may affect the quality of
<br />storm water discharges and includes a list of BMPs to provide sediment and erosion control, waste
<br />handling measures, and non - stormwater management. As such, any storm flow discharges that
<br />deposit into the Santa Ana River would not result in a substantial adverse effect on federally
<br />protected wetlands and impacts would be less than significant.
<br />d. Interfere substantially with the movement of any native resident or migratory fish or wildlife
<br />species or with established native resident or migratory wildlife corridors, or impede the use of
<br />native wildlife nursetysites?
<br />Less - than - Significant Impact with Mitigation Incorporated. The project site is located within a
<br />fully developed environment and is surrounded by roadways and medical and residential
<br />development. Further, the project site is bound on three sides by a block wall that averages 6 -feet in
<br />height. There are no running waters, drainages, or other corridors that allow for wildlife movement
<br />on or within the vicinity of the project site. As such, the proposed project site is not within an
<br />established wildlife corridor, and the proposed project would not interfere with the movement of
<br />any native wildlife species. Additionally, the project would not involve the construction of extensive
<br />facilities or fences that could impede wildlife movement. The proposed project would not interfere
<br />with the movement of any native resident or migratory wildlife species or with established native
<br />resident or migratory wildlife corridors, and would not impede the use of native wildlife nursery
<br />sites.
<br />However, as described above, the project site contains numerous ornamental trees, which may
<br />support nesting birds. The Migratory Bird Treaty Act (MBTA) protects all common wild birds found
<br />in the United States except the house sparrow, starling, feral pigeon, and resident game birds such as
<br />pheasant, grouse, quail, and wild turkey. The MBTA makes it unlawful for anyone to kill, capture,
<br />collect, possess, buy, sell, trade, ship, import, or export any migratory bird including feathers, parts,
<br />nests, or eggs. Further, the CDFG Code 3503 makes it illegal to destroy any birds' nest or any birds'
<br />eggs that are protected under the MBTA.
<br />Potential impacts on nesting birds may occur if removal of the existing ornamental tees occurs
<br />during the breeding season (February 15 through September 15). Therefore, Mitigation Measure
<br />B10 -1 requires preconstruction nesting bird surveys to be conducted and appropriate buffer areas
<br />established around any active nests, if tree removal is to occur between February 15 and September
<br />15. Implementation of Mitigation Measure B10 -1 would reduce potential impacts to nesting birds to
<br />a less -than- significant level.
<br />e. Conflict with any local policies or ordinances protecting biological resources, such as a tree
<br />preservation policy or ordinance?
<br />No Impact. The City of Santa Ana does not have any local policies or ordinances protecting
<br />biological resources at the project site. As a result, the proposed project would not conflict with any
<br />local policies or ordinances protecting biological resources, and impacts would not occur.
<br />f. Conflict with the provisions of an adopted habitat conservation plan, natural community
<br />conservation plan, or other approved local, regional, or state habitat conservation plan?
<br />No Impact. There are no Habitat Conservation Plans (HCPs), Natural Community Conservation
<br />Plans (NCCPs), or other approved local, regional, or state habitat conservation plans that apply to
<br />the project site. Therefore, there are no impacts related to this issue, and no mitigation is required
