CONDITIONAL USE PERMIT NOS. 2012-11, 2012-12 AND 2012-13 <br />(Continued by Planning Commission on August 27, 2012 to September 10, 2012) <br />Filed by Robert Quinn to allow The Playground restaurant a conditional use permit for <br />' a Type 47 Alcoholic Beverage Control (ABC) license for the on -premise sale and <br />consumption of beer, wine and distilled spirits; to allow after-hours operation, and to <br />allow a banquet facility at 220 East Fourth Street, Suite 102, located in the Downtown <br />(SD84) zoning district. <br />PUBLISHED IN THE ORANGE COUNTY REPORTER: August 31, 2012 <br />PUBLICLY NOTICED: August 30, 2012 <br />RECOMMENDATION: <br />1. Confirm the Zoning Administrator's action approving Conditional Use Permit No. <br />2012-12 to upgrade a Type 41 ABC license to a Type 47 ABC license as <br />conditioned. <br />2. Adopt a resolution approving Conditional Use Permit No. 2012-11 to allow the <br />restaurant's hours of operation to extend to 2:00 a.m. as conditioned. <br />3. Adopt a resolution approving Conditional Use Permit No. 2012-13 to allow the <br />restaurant to be used as a banquet facility as conditioned. <br />Associate Planner Hally Soboleske presented the staff report and recommendation. <br />SAPID McCoy provided Police modifications to conditions of approval on Conditional <br />Use Permit Nos. 2012-11 Exhibit A page 2 of 2, Items 4 (ambient music) and item 13 <br />' (entertainment); and Conditional Use Permit No. 2012-13, Exhibit B page 1 of 2 item <br />4 (entertainment). <br />No written communications were received. <br />Vice Chairman Gartner opened the public hearing. Resident Darren Shippen spoke <br />in support of the project. The public hearing was closed. <br />MOTION: <br />Confirm the Zoning Administrator's action approving Conditional Use Permit <br />No. 2012-12 to upgrade a Type 41 ABC license to a Type 47 ABC license as <br />conditioned.
