A-2010-078-01 <br />RANCE NOT ON FILE WORK rROCEF <br />WOR Y UQJ pRQC UNTIL M- l{F;r; F <br />?'LER = C(+ 1L CLERK <br />-' ' ?- <br />r' TE' - 2 AT E, <br />AMENDMENT TO AGREEMENT <br />THIS MENDMENT TO AGREEMENT is entered into on May 10, 2012, by and <br />between Clinical Laboratory of San Bernardino, a California corporation ("Consultant") and the <br />City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). <br />RECITALS: <br />J <br />A. The parties entered into that certain Consultant Agreement #A-2010-078, dated May 3, 2010, <br />(hereinafter "said Agreement") by which Consultant has provided domestic water quality <br />testing. <br />--' B. In accordance with the terms and conditions of said Agreement, the City desires to exercise <br />its option to extend the teen for an additional two-year period on the terms and conditions set <br />forth in said Agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Amendment to <br />Agreement, the parties agree as follows: <br />1. Consultant shall continue to provide domestic water quality testing as set forth in Exhibit A to <br />said Agreement, at the rates and charges set forth in Exhibit B to said Agreement. <br />2. Section 3, COMPENSATION, shall be deleted in its entirety and replaced with the following: <br />"a. City agrees to pay, and Consultant agrees to accept as total payment for its services, the <br />rates and charges identified in Consultant's Fee Proposal, attached hereto as Exhibit B, and <br />incorporated by reference. The total sum to be expended under this Agreement shall not <br />exceed $104,918.00, during each two-year term of this Agreement. <br />3. Section 4, TERM, shall be amended to extend the term for an additional two-year period, <br />through June 30, 2014. <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Amendment to Consultant <br />Agreement on the date and year first written above. <br />ATTEST: <br />MA I R.
