N7 ,'ERK FOURTH AMENDMENT TO AGREEMENT A- 2011 -228 j FOR THE PROVISION OF INMATE MEDICAL SERVICES BETWEEN THE CITY OF SANTA ANA AND CORRECTIONAL MANAGED CARE MEDICAL CORPORATION II, THIS FOURTH AMENDMENT TO AGREEMENT, is entered into this day of e- 2011, by and between the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ( "City ") and Correctional Managed Care Medical Corporation ( "Contractor "). RECITALS: A. City and Contractor entered into Agreement #A- 2007 -193, dated August 20, 2007, for the Provision of Inmate Medical Services, hereinafter referred to as "said Agreement ". UB. City and Contractor entered into a First Amendment, Second Amendment, and Third Amendment, which each renewed the term of said Agreement for an additional one -year period and approved the maximum obligation to be expended for services during that renewed term. C. The Parties desire to renew the term of said Agreement for an additional one -year period, approve the maximum obligation to be expended for services during that renewed term, and amend said Agreement to provide for an additional one -year extension. NOW, THEREFORE, in consideration of the mutual and respective promises, and subject to all the terms and conditions of said Agreement, except as herein modified, the parties agree as follows: Section 1, TERM, shall be extended for an additional one -year period to August 31, 2012. 2. Section 3.a., COMPENSATION, shall be deleted in its entirety and replaced with the following: "a. The Total Annual sum to be expended under this Agreement for staffing, pharmaceutical, supplies and other services shall not exceed $1,313,075.00, during the renewal term, from September 1, 2011 to August 31, 2012. During that renewal term, the total payments for inmate medical services shall not exceed $1,213,075.00. An additional amount up to $100,000.00 shall be available for Additional Services as listed in Section 13 of the RFP, during the renewal term." 3. Except as hereinabove modified, all terms and conditions of said Agreement shall remain in full force and effect.
