R DCEEU <br />CLERK Ci[: ;C NCOh. <br />DATE: <br />FIRST AMENDMENT TO AGREEMENT <br /> <br />A-2011-253-01 <br />THIS FIRST AMENDMENT TO AGREEMENT, made and entered into this 1st day of July, 2012, <br />by and between United Stormwater, Inc., a California corporation (hereinafter referred to as <br />"CONTRACTOR" ) and the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California (hereinafter referred to as ("CITY"). <br />RECITALS: <br />o° A. The parties entered into that certain Agreement #A-2011-253 dated November 21, 2011 (hereinafter <br />"said Agreement") for the provision and installation of "Automatic Retractable Screen Excluders, <br />Connector Pipe Screen Full Capture Systems and Catch Basin Inserts" (hereinafter referred to as <br />"Catch Basin Screens") in the Wintersburg Channel located in the City of Santa Ana; <br />B. The Project has not yet been completed and, in accordance with the terms and conditions of said <br />Agreement, the parties wish to extend the term for an additional one-year period to allow time to <br />complete the Project. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the <br />terms and conditions of said Agreement, except those amended in this First Amendment to Agreement, <br />the parties agree as follows: <br />Section 7, TERM, shall be amended to extend the termination date for one additional year, <br />through June 30, 2013. <br />Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full <br />force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Agreement on <br />the date and year first written above. <br />ATTEST: <br />,U- <br />MARIA D.
