A- 2012 -018 <br />Contract No. <br />C/ AGREEMENT UNDER THE WORKFORCE INVESTMENT ACT <br />THIS AGREEMENT, dated for reference purposes, February 6, 2012, by and between <br />the City of Santa Ana, a charter city and municipal corporation duly organized and existing under the <br />Constitution and laws of the State of California ( "CITY ") and Growth Sector, a 501 (c)(3) non -profit <br />corporation ( "CONTRACTOR "). <br />W- I- T- N- E- S- S -E -T -H <br />Recitals: <br />A. CITY has been designated a Local Workforce Investment Area (LWIA) under <br />the Workforce Investment Act of 1998, Public Law 105 -220 ( "the Act "). <br />B. The State of California has created the LWIA to administer the Act programs <br />operated by the State of California pursuant to the Act. <br />C. As a LWIA, CITY is entitled to receive federal funds to establish programs to <br />increase training opportunities for unemployed individuals. One goal of California's Workforce <br />Investment System is to provide the opportunities to find retain, or advance their employment. <br />D. CONTRACTOR is experienced in operating education, occupational <br />development and employment programs for economically disadvantaged youths for entry into the labor <br />market ( "said program "). <br />E. CONTRACTOR is willing to operate said program pursuant to the Act and <br />California law. <br />WHEREFORE, for and in consideration of the respective and mutual covenants and <br />promises hereinafter contained and made, and subject to all the terms and conditions hereof, the parties <br />hereto do hereby agree as follows: <br />I. <br />CONTRACTOR'S OBLIGATIONS <br />A. CONTRACTOR agrees to act as the Project Liaison for the H -113 Technical <br />Skills Training Grant, Orange County Bridge to engineering with the City of Santa Ana Workforce <br />Investment Area, hire the student support specialists, coordinate on the job training among employer <br />and education partners, convene instructional design team in addition to the activities outlined in the <br />Scope of Work (Exhibit A) which includes the Letter of Commitment from the H -1B application to the <br />Department of Labor, and activities outlined in Budget Narrative (Exhibit E).
