ASURANCE N01' ON FILE <br />WORK MAY N a I PROCEEi: <br />LERK CF=UNCI <br />f_ DATE: 'Z, <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on June 4, 2012, by and <br />between Houston Harris PCS, Inc. ("Consultant") and the City of Santa Ana, a charter city and <br />municipal corporation organized and existing under the Constitution and laws of the State of <br />California ("City"). <br />THIRD AMENDMENT TO AGREEMENT <br />A-2012-108 <br />RECITALS: <br />A. The parties entered into Agreement A-2009-141, dated September 8, 2009, (hereinafter "said <br />Agreement") by which Consultant has provided sanitary sewer inspection and cleaning <br />services. <br />B. The parties executed a First Amendment to said Agreement on July 5, 2010, to extend the <br />term and add compensation for the extended term. <br />C. The parties executed a Second Amendment, dated July 18, 2011, to extent the term and add <br />compensation for the extended term. <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to amend <br />said Agreement to extend the term for an additional one-year period and increase the amount <br />of compensation to pay for services during the extended term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Third Amendment to <br />Agreement, the parties agree as follows: <br />1. Section 3, COMPENSATION, shall be amended to increase compensation to $300,000.00, to <br />pay for sanitary sewer inspection and cleaning services, at rates set forth in said Agreement, <br />during FY 2012-2013. <br />2. Section 4, TERM, shall be amended to extend the term for an additional one-year period, <br />through June 30, 2013. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />
