Amendment to CUP No. 2011-07 <br />October 31, 2012 <br />Page 3 <br />Proiiect Background <br />Karmina Restaurant is an independently-owned restaurant specializing in Mexican casual cuisine. <br />This business has been operating at this location since February 2008, Several restaurant tenants <br />have occupied the space over the years; however, none have had an ABC license. With the <br />exception of several special events held in the banquet hall on the second floor, the restaurant has <br />not begun to serve alcohol. <br />Until recently, the restaurant primarily served the area's weekday lunch crowd and operated from <br />10:00 a.m. until 4:00 p.m. The restaurant has been closed in order to begin construction of the new <br />tenant improvements. When the applicant completes the remodel of the building he plans to operate <br />from 11:00 a.m. until 10:00 p.m. Monday through Thursday, 10:00 a.m. anti{ 2:00 a.m. on Friday and <br />Saturday, and from 9:00 a.m. until midnight on Sunday. <br />General Plan and Zonin Consistenc <br />The General Plan land use designation for the site is District Center (DC}. District Center districts <br />provide highly visible and accessible commercial development within the City's major development <br />areas such as the downtown area and along the City`s arterial transportation corridors. These <br />districts also provide important neighborhood facilities and services, such as this restaurant. The <br />project site is consistent with this General Plan land use designation. <br />The zoning for the site is Specific Development No. 84 (SD-84~fransit Zoning Code). The SD-84 <br />zoning district allows for retail and service uses such as restaurants, making the proposed use <br />consistent with the zoning code. <br />Pro'ec~ Anal sis <br />Conditional Use Permit requests are governed by Section 41-638 of the SAMC. Conditianal Use <br />Permit requests may be granted when it can be shown that the following can be established: <br />• That the proposed use will provide a service or facility which wi11 contribute to the genera! well <br />being of the neighborhood or community. <br />• That the proposed use will not, under the circumstances of the particular case, be detrimental to <br />the heal#h, safety, or general welfare of persons residing or working in the vicinity. <br />• That the proposed use adversely will not affect the present economic stability or future economic <br />development of properties surrounding the area. <br />• That the proposed use will comply with the regulations and conditions specified in Chapter 41 far <br />such use. <br />
