RESOLUTION NO. 2012-047 <br />Lss8/22/12 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AUTHORIZING THE SUBMITTAL OF AN <br />APPLICATION TO ORANGE COUNTY TRANSPORTATION <br />AUTHORITY FOR FUNDING UNDER THE MEASURE M2 <br />ENVIRONMENTAL CLEANUP PROGRAM FOR THE <br />DEVELOPMENT OF AN URBAN DISCHARGE DIVERSION <br />FACILITY IN THE SANTA ANA DELHI CHANNEL <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1: The City Council of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. The Orange County Transportation Authority (OCTA) has <br />authorized Measure M2 Environmental Cleanup Program (ECP) <br />funding for projects which help to protect Orange County beaches <br />and waterways from transportation-generated pollution (urban <br />runoff) and improve overall water quality; and <br />B. The OCTA Environmental Cleanup, Tier 2 Grant Program, provides <br />funds for regional, potentially multi jurisdictional, capital-intensive <br />projects which mitigate pollutants including litter and debris, heavy <br />metals, organic chemicals, sediment, and nutrients; and <br />C. The City of Santa Ana has the authority to nominate water quality <br />improvement projects which have a transportation pollution nexus, <br />to finance and construct the proposed project; and <br />D. The City will provide matching funds for the project as required by <br />the Comprehensive Transportation Funding Programs Procedures <br />Manual. <br />Section 2: The City Council of the City of Santa Ana nominates the Santa <br />Ana Delhi Channel Diversion Project, and authorizes the Executive Director of <br />the Public Works Agency to submit application to OCTA for Measure M2 <br />Environmental Cleanup Program funding for the Project. <br />Section 3: The City Council appoints the City Manager, or the <br />Executive Director of the Public Works Agency, or their designees, as agent for <br />the City of Santa Ana to conduct all negotiations, execute and submit all <br />documents, including applications, agreements, amendments, payment requests <br />Resolution No. 2012-047 <br />Page 1 of 3
