Agreement No. D12-015 <br />Bikeways and Trails in the City of Santa Ana <br />property arising out of any rerouting of any pedestrian/bikeway and/or trail caused by the <br />relocation of the RECREATION IMPROVEMENTS. <br />DISTRICT shall provide CITY with at least one working day notice of the need to temporarily <br />close a RECREATION IMPROVEMENT to allow DISTRICT to work on PREMISES unless <br />emergency conditions require immediate action by DISTRICT in which case CITY shall be <br />notified within a reasonable period of time. <br />4.3. NO RELOCATION OBLIGATION <br />CITY agrees that DISTRICT shall not under any circumstance be obligated to provide or locate <br />for CITY a replacement site for CITY's RECREATION IMPROVEMENT or operations in the event <br />this agreement is terminated or PREMISES is reduced or otherwise modified as discussed in this <br />agreement. <br />4.4. EMERGENCY RESTRICTIONS ON USE <br />CITY agrees that DIRECTOR may temporarily suspend public use of PREMISES if DIRECTOR <br />determines, in DIRECTOR's sole and absolute discretion that emergency conditions exist such <br />that use of PREMISES by the general public present a risk to the general public's health, safety <br />or welfare. DISTRICT shall notify CITY as soon as practicable of the emergency. <br />ARTICLE 5 <br />PROHIBITED USES <br />5.1. MOTORIZED VEHICLES <br />CITY shall not allow any non-DISTRICT or non-CITY motorized vehicles, except private <br />maintenance vehicles specifically authorized under contract with CITY, to operate within the <br />PREMISES. <br />5.2. HAZARDOUS MATERIALS <br />CITY shall not cause or permit any "HAZARDOUS MATERIAL" as hereinafter defined, to be <br />brought upon, kept, or used in or about the PREMISES.
