because of his operation, then these will be considered to be of an emergency nature and <br />cause the City to move in on the project to make corrective work. Such work will be done on a <br />force account basis with an additional callout charge of Two Hundred Dollars ($200.00) for <br />each callout. <br />XXVI.PAYMENT <br />The Contractor will be paid after completion of the project, upon approval and payment to <br />the City by Southern California Edison. Contractor shall submit a detailed report of work <br />performed and materials used in the project. This report shall be accompanied by a billing <br />in accordance with the contract price for the work performed, and shall become basis for <br />payment. <br />XXVII.APPRENTICESHIP STANDARDS <br />Where required under law, the contractor on this project shall assume full responsibility <br />for compliance with apprenticeship standards as established by Section 1777.5 of the <br />California State Labor Code. <br />XXVIII.SUBCONTRACTORS <br />The successful proposer shall not, without the written consent of the City <br />A. Substitute any person or firm as subcontractor in place of the subcontractor <br />designated in the original proposal. <br />B. Permit any subcontract to be assigned or transferred or allow it to be performed <br />by anyone other than the original subcontractor listed in the proposal. <br />C. Subcontract any portions of the work after bid is submitted if the cost thereof <br />exceeds one-half (1/2) of one (1) percent of the total proposal and a subcontractor was <br />not designated for the work in the original proposal. <br />XXIX.MISCELLANEOUS PROVISIONS <br />A. Each undersigned represents and warrants that its signature herein below has <br />the power, authority and right to bind their respective parties to each of the terms of this <br />Agreement, and shall indemnify City fully, including reasonable costs and attorney's <br />fees, for any injuries or damages to City in the event that such authority or power is not, <br />in fact, held by the signatory or is withdrawn. <br />B. All exhibits referenced herein and attached hereto shall be incorporated as if fully <br />set forth in the body of this agreement. <br />H <br />20D-12
