"a. City agrees to pay, and Consultant agrees to accept as total payment for all <br />services set forth in Section 1, above, an amount of $615,966, as set forth in Exhibit <br />B - Cost Estimate dated January 4, 2013, attached hereto. The Executive Director <br />may authorize in writing, additional services unanticipated at this time but necessary <br />to complete the Design/Engineering and Environmental review of the Project. Said <br />services will be provided at the hourly rates set forth in Exhibit B, and shall not <br />exceed a total of $25,000.00. The total amount to be expended pursuant to this <br />Agreement, including the contingency, shall not exceed $640,966, during the term of <br />this Agreement." <br />3. Section 5, TERM, shall be amended to extend the termination date to June 30, 2014, <br />unless terminated earlier in accordance with Section 14 of Restated Agreement. <br />4. All Exhibits referenced above shall be incorporated in this Amendment by such <br />reference. <br />5.
