17. Will comply with Homeland Security Presidential Directive (HSPD)-5, Management of Domestic Incidents.
<br />The adoption of the NIMS is a requirement to receive Federal preparedness assistance, through grants,
<br />contracts, and other activities. The NIMS provides a consistent nationwide template to enable all levels of
<br />government, tribal nations, nongovernmental organizations, and private sector partners to work together to
<br />prevent, protect against, respond to, recover from, and mitigate the effects of incidents, regardless of cause,
<br />size, location, or complexity.
<br />18. Will comply with all applicable requirements of all other Federal laws, executive orders, regulations and
<br />policies governing this program. This includes all requirements, restrictions and regulations identified in the
<br />California Emergency Management Agency (Cal EMA) Fiscal Year 2012 Emergency Management
<br />Performance Grant (EMPG) Program - California Supplement to the Federal Program Funding Opportunity
<br />Announcement.
<br />19. Will not dispose of, modify the use of, or change the terms of the real property title, or other interest in the
<br />site and facilities without permission and instructions from the awarding agency. Will record the Federal
<br />interest in the title of real property in accordance with awarding agency directives and will include a
<br />covenant in the title of real property acquired in whole or in part with Federal assistance funds to assure non-
<br />discrimination during the useful life of the project.
<br />20. Will comply with the requirements of the assistance awarding agency with regard to the drafting, review
<br />and approval of construction plans and specifications.
<br />21. Will provide and maintain competent and adequate engineering supervision at the construction site to ensure
<br />that the complete work conforms with the approved plans and specifications and will furnish progress reports
<br />and such other information as may be required by the assistance awarding agency or State.
<br />22. Will comply with Public Law (PL) 109-282 (Federal Funding Accountability and Transparency Act of 2006),
<br />as amended by Section 6202(a) of the Government Funding Transparency Act of 2008 (PL 110-252), which
<br />is outlined in FEMA GPD Information Bulletin NO. 350. If the subgrantee in the preceding year did not get
<br />80% or more of its annual gross revenues from Federal Awards, and $25M or more in annual gross revenues
<br />from Federal Awards, and the public does have access to information about the compensation of the senior
<br />executives of the entity, then the subgrantee is not subject to the FFATA Financial Disclosure requirements.
<br />CERTIFICATIONS
<br />1. CERTIFICATION FOR CONTRACTS GRANTS LOANS AND COOPERATIVE AGREEMENTS
<br />The undersigned certifies, to the best of his or her knowledge and belief, that:
<br />(1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any
<br />person for influencing or attempting to influence an officer or employee of an agency, a Member of Congress,
<br />an officer or employee of Congress, or an employee of a Member of Congress in connection with the
<br />awarding of any Federal contract, the making of any Federal grant, the making of any Federal loan, the
<br />entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or
<br />modification of any Federal contract, grant, loan, or cooperative agreement. See Article III.
<br />(2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing
<br />or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or
<br />employee of Congress, or an employee of a Member of Congress in connection with this Federal contract,
<br />grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-LLL,
<br />"Disclosure Form to Report Lobbying," in accordance with its instructions.
