C-2-1640 <br />F. AUTHORITY shall reimburse CITY within thirty (30) days following receipt of an invoice <br />which is complete, properly prepared, and complies with the requirements of ARTICLE 5 below. <br />G. AUTHORITY shall cancel projects for which the CITY has not awarded a construction <br />contract by June 30th of the fiscal year identified in Exhibit A. <br />ARTICLE 4. RESPONSIBILITIES OF CITY <br />CITY agrees to the following responsibilities for PROJECT: <br />A. CITY agrees that all funds received pursuant to ARTICLE 3 paragraph A, shall be <br />used exclusively to construct the PROJECT per the TE Call for Projects TE application and <br />amendments provided by the CITY, approved by the AUTHORITY, and herein incorporated by <br />reference. <br />B. CITY will act as the lead AGENCY for the engineering, right-of-way, construction and <br />construction management of the PROJECT. <br />C. CITY is responsible for submitting quarterly reports as specified in Exhibit B titled <br />"FTA 5307 Quarterly Report Form" included in this agreement and incorporated into and made part <br />of the agreement for the PROJECT due on April 15, August 15, October 15 and January 15 of each <br />year. <br />D. CITY acknowledges that if the construction contract for the construction phase for <br />PROJECT is not awarded, by June 30 within the fiscal year identified in Exhibit A, the proposed <br />funding will be cancelled by AUTHORITY. <br />E. CITY agrees to provide a minimum of 25% of the final project cost in CITY funds as <br />the required local match. Based on the existing budget, this amount is estimated to be Fifty Four <br />Thousand Seven Hundred Fifty Dollars ($54,750). Actual match will be determined based on <br />construction contract award amount. <br />F. CITY agrees that the overall budget for this PROJECT is not -to -exceed amount of <br />Two Hundred Nineteen Thousand Dollars ($219,000); contingent on approval of FTA Section 5307 <br />funds by the FTA. <br />Page 5 of 12 <br />L CamrMCLERICAL\CLERICAL\WORDPRDC\AGREE\AG21640.doc <br />
