• • <br />(i) A 1000 sq. ft. room for storage of equipment in the Performing Arts <br />Building or Band /Choral Building for uniform and instruments. The <br />City shall be entitled to permit use of this storage facility by other <br />community -based musicals and /or arts organizations; <br />(ii) A 200 sq. ft. room for dedicated storage space in the gymnasium for <br />City storage of recreation and other City equipment; <br />(iii) The public restroom facilities in the gymnasium shall include <br />locker /changing facilities to be used as part of City sponsored sports <br />programming in the gym. The locker /changing facilities shall include <br />reasonably necessary privacy and controlled access elements for the <br />City's users. <br />6. Financial Conditions. District agrees to the following financial conditions <br />required by City: <br />6.1 Fees. The District shall pay all required fees, including, but not limited to, <br />plan check, sewer connection, Orange County Sanitation District, Water Quality <br />Management, and other required fees unless exempt, and where exempt District shall <br />provide City with written documentation of the exemption. <br />6.2 Escrow Account. The District shall set aside from the funds identified in <br />Sections 4.3 and 4.4 in an interest bearing escrow account an amount agreed upon by the <br />City Manager and the District's Superintendent estimated at the construction costs of the <br />various improvements called for in Subsections 5.1 -5.4, 5.6 -5.9 and 5.11 -5.12 of this <br />Lease, and any other required off -site improvements. All interest thereunder shall accrue <br />to the District. <br />6.3 Offset for Loss of County Maintenance Funding. The City and the <br />District agree that the addition of the School to Centennial Park does not diminish the <br />regional character of Centennial Park and therefore the County of Orange (the "County ") <br />should continue to honor its agreement with the City to share maintenance costs of <br />Centennial Park. The City and the District further agree to work in concert to achieve <br />such agreement with the County. However, in the event the County refuses to so <br />participate, the District agrees to pay to City, within sixty (60) days of when otherwise <br />due, the County's obligation not to exceed the sum of One Hundred and Twenty Five <br />Thousand Dollars ($125,000.00) per year for up to three years from Commencement <br />Date, to offset the loss of County maintenance funds for Centennial Park. <br />7. Time of Performance of Desien and Construction of Facilities. District shall <br />begin construction within 120 days of the Commencement Date and thereafter proceed in good <br />faith to complete construction of all of the School Improvements. <br />8. Option to Purchase. It shall be the sole and exclusive right of District at any <br />time during the term of this Lease to purchase the Premises from City, or from City's successors <br />in interest in the Premises, for the sum of ONE DOLLAR ($1.00), subject to the concurrence of <br />2 <br />
