CITY shall subsidize five (5) DTI events at the CITY's choosing. When <br />subsidizing an event, CITY shall charge DTI 50% of the standard "fully loaded" CITY related <br />costs; shall, upon request, provide DTI with barricades, stages, canopies, etc., as reasonably <br />necessary and available from the CITY, at 50% of the standard costs; and, shall charge 50% of <br />the standard CITY event fees. CITY Department Heads, or their designees, will be needed to <br />address issues related to significant events that affect their departments, and would be requested <br />upon reasonable invitation and notice. If the BID is not reactivated by August 1, 2013, as <br />discussed in section 5 above, DTI will waive this section 6 of the CITY obligations. <br />DTI Obligations: <br />1. On or before January 31, 2013, all DTI contracts, except for the contracts for <br />performing the Clean and Safe services referenced in paragraph 4 of CITY's obligations above <br />and its contract with its attorney to complete the resolution of the DISPUTE must be terminated <br />with the minimum required notice. DTI may continue at its' option with contracts if it is clear <br />that neither DTI nor the contractor may look to the CITY for funding. <br />2. DTI shall, upon written notice from CITY, cooperate in an audit of expenditures <br />from January 1, 2012, through the close out of operations on January 31, 2013. If the CITY's <br />audit process requires the assistance of DTI staff, the CITY shall reimburse DTI at the actual <br />hourly rate for the actual time invested by DTI staff in the audit. DTI staff shall fully and <br />completely comply with all reasonable requests from the CITY in a thorough and timely manner. <br />3. DTI shall retain all personal property acquired in connection with performing <br />under the CMD Services Agreement. DTI represents that all such personal property is paid for <br />in full. Equipment related to the Clean and Safe Program, including, but not limited to, the <br />electric cart and radios used by the security firm, must be available to the CITY, through either <br />transfer or license, so that the applicable Clean and Safe Program service can be provided <br />without the CITY having to purchase equipment. <br />4.
