A-2012-088 <br />1 AMENDMENT NO. 3 TO <br />2 AGREEMENT NO. C-8-1157 <br />3 BETWEEN <br />4 ORANGE COUNTY TRANSPORTATION AUTHORITY <br />5 AND <br />6 CITY OF SANTA ANA <br />7 FOR <br />8 CITY OF SANTA ANA FIXED-GUIDEWAY PROJECT <br />9 THIS AMENDMENT NO. 3 is effective this oZW?" day of 1?W?YwbPY 2012, by and between the <br />10 Orange County Transportation Authority, a public corporation of the State of California ("AUTHORITY"), <br />11 and the City of Santa Ana, a municipal corporation duly organized and existing under the constitution <br />12 and laws of the State of California ("CITY"), mutually referred to herein as "PARTIES" or each <br />13 individually as a "PARTY". <br />14 WITNESSETH: <br />15 WHEREAS, by Agreement No. C-8-1157 dated September 9, 2008, as last changed by <br />16 Amendment No. 2 dated February 27, 2012, AUTHORITY and CITY entered into a contract whereby <br />17 the CITY proposes to construct and operate a fixed guideway system linking Santa Ana Regional <br />18 Transportation Center to Harbor Boulevard in the City of Garden Grove which includes the use of the <br />19 Pacific Electric Right-of-Way; and <br />20 WHEREAS, CITY has requested a programming change that would advance M2 Project S <br />21 funds to complete preliminary engineering for the purposes of completing the current environmental <br />22 phase; and <br />23 WHEREAS, AUTHORITY and CITY agree to increase the maximum cumulative payment <br />24 obligation amount of the Agreement by Four Hundred Eighty Eight Thousand Dollars ($488,000); and <br />25 WHEREAS, AUTHORITY's Board of Directors, on May 14, 2012, approved the re- <br />26 programming of Four Hundred Eighty Eight Thousand Dollars ($488,000) of Renewed Measure M <br />Page 1 of 4
