The initiative provides that upon issuance of a Registration, the applicant is eligible for a <br />Certificate of Occupancy (C of O). The initiative requires that inspections be completed <br />and the C of O issued within 30 days of application unless tolled by the applicant. It can <br />be denied with a written justification, but is deemed issued if this does not occur within <br />30 days. This provision could circumvent the California Building Code and create an <br />unsafe situation. <br />Planning Conclusion <br />As it is written, the initiative fails to provide an adequate regulatory framework under <br />which to permit the establishment of medical marijuana collectives and cooperatives, <br />however it would allow a relatively small number of establishments and would provide <br />some structure to what is essentially an unregulated use today. <br />13 <br />65A-19
