January 24, 2013 The proponents of the Santa Ana Medical Cannabis Restriction <br />and Limitation Initiative filed their petition with the City Clerk. The <br />City Clerk's Department staff examined the petition and <br />determined the number of signatures, prima facie, was in excess <br />of the number of signatures required for either a 10 percent or 15 <br />percent count. The petition was accepted as filed on this date. <br />January 25, 2013 The City Clerk hand-delivered the petition to the Orange County <br />Registrar of Voters for validation of the signatures. The petition <br />contains a clause requesting a special election, which requires <br />that the petition be signed by at least 15 percent of the registered <br />voters (16,374). Therefore, the Registrar of Voters was directed to <br />perform a three percent (3%) random sample of the signatures <br />contained in the petitions. Based on the sample, the Registrar <br />determined that 77.8% of the signatures were valid and 22.2% <br />were invalid. The Registrar projected that 13,240 signatures <br />would be valid. The projected valid signatures equal more than <br />110% of the number of signatures required to qualify for the 2014 <br />General Election, but are not sufficient to qualify for a special <br />election. The official Report of Registration to the Secretary of <br />State for the City of Santa Ana, which was effective at the time the <br />Notice to Circulate was published, indicates that there are 109,155 <br />registered voters in Santa Ana. Therefore, 10 percent or 10,916 <br />valid signatures were required to qualify the petition for the ballot. <br />February 4, 2013 The Registrar of Voters examined the petition and, based on the <br />official records of voter registration, certified that a sufficient <br />number of valid signatures were attached to the petition. <br />February 19, 2013 The City Clerk reported to the City Council that the petition <br />contained verified signatures of at least 10 percent of the voters of <br />the City, complied with the technical requirements in that the <br />required statements, fonts and signatures were on the petition, <br />and certified the petition. The City Council's action at that meeting <br />was to order a report pursuant to Elections Code Section 9212. <br />2 <br />65A-8
