H. The Operator shall keep all glass surfaces in and around attendant booths, Parking <br />Manager's office, stairwells and elevators clean. <br />The Operator shall keep all parking control equipment, including housings, clean <br />and well maintained as recommended by service manuals. <br />J. The Operator shall be responsible for maintaining all painted surfaces on parking <br />equipment, attendant booths, posts, curbs and islands. Painting shall be provided <br />in a professional manner including but not limited to surface preparation and <br />priming as needed. The Contract Administrator must approve paint colors. <br />If the Operator fails to maintain or make repairs or replacements as required herein, the Contract <br />Administrator shall notify the Operator in writing of said failure. Should the Operator fail to <br />correct the situation within three (3) days after receipt of written notice, the Contract <br />Administrator may make the necessary correction or cause it to be made and the cost thereof, <br />including but not limited to the cost of labor, materials, equipment, and an administrative fee <br />equal to twenty five percent (25%) of the sum of such items, shall be paid by the Operator by <br />means of deduction from the monthly compensation due the Operator. <br />13. RESPONSIBILITIES AND REQUIREMENTS OF OPERATOR <br />The Operator shall, in the manner and method of operating the Parking Facilities, assure the <br />highest degree and standards of courtesy, politeness, conduct, and demeanor on the part of its <br />officers, agents, employees, and representatives, and shall at all times during the term of this <br />Agreement, comply fully with the following conditions and requirements: <br />A. The Operator shall charge and collect from all persons utilizing the parking <br />facilities within the Parking Facilities the fees or charges established by the City. <br />B. The Operator shall conduct its operations in a manner so as not to annoy, disturb, <br />or be offensive or rude to customers, patrons, or other users of the Parking <br />Facilities. <br />C. Language Proficiency. The Operator shall select personnel that have the ability to <br />read signs, labels, work schedules and simple instructions in both English and <br />Spanish; understand and follow oral directions in English and Spanish; write <br />simple messages in English and Spanish, and speak both languages sufficiently to <br />communicate clearly with the public. <br />D. Parking Manager. The Operator shall select and appoint a Parking Manager <br />whose responsibility shall be overseeing the operation of the Parking Facilities. <br />Such person must be highly qualified, experienced, and successful manager of <br />parking facilities, vested with full power and authority with respect to the method <br />and manner of operating the Parking Facilities. The Parking Manager shall be <br />present on-site a minimum of eight hours per day between the hours of 7:00 am <br />and 6:00 pm. The Parking Manager shall maintain an office on-site and shall be <br />available upon 15 minutes notice during regular business hours. At all times <br />14 <br />25A-18
