INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE: <br />Firm <br />VCN- SITMIdi9 AMENDMENT EXTENDING NON - EXCLUSIVE <br />OPERATING AGREEMENT FOR PUBLIC PARKING <br />GARAGES AND SURFACE LOT STAFFING AND FIELD <br />MANAGEMENT BETWEEN THE CITY OF <br />SANTA ANA AND PARKING CONCEPTS, INC. <br />N- 2013 -027 <br />Fi Fiti <br />THIS &Ee-9ND AMENDMENT EXTENDING NON - EXCLUSIVE OPERATING <br />AGREEMENT is entered into on this 19 h day of 2013, by and between Parking Concepts, Inc., <br />a Delaware corporation ( "Operator ") and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ( "City "). <br />RECITALS: <br />A. The City entered into the Non - Exclusive Operating Agreement for Public Parking <br />Garages and Surface Lot Staffing and Field Management Between the City of Santa Ana and <br />Parking Concepts, Inc. (Agreement #2007 -253) dated December 31, 2007 ( "said Agreement "), <br />with Operator by which Operator has operated and managed the City's Parking Garages and <br />Surface Parking Lots. <br />B. In accordance with said Agreement, the parties exercised its three Options to said <br />Agreement. The City issued a new Request for Proposals for a management contract for a <br />parking operator dated November 20, 2012. <br />C. An amendment ( #A- 2012 -27) was entered by and between the parties on November <br />19, 2012, in order to extend the term to April 1, 2013 to allow for additional time to evaluate the <br />proposals. <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to <br />again extend the term for one (1) additional month while the City completes evaluation of the <br />proposals submitted and awards a new agreement. <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter <br />contained and made, and subject to all of the terms and conditions of said Agreement, the parties hereto do <br />hereby agree as follows: <br />1. Section 3 "Term of Agreement" shall be extended for an additional one (1) month period to May 1, <br />2013. <br />2. Section 4 "Compensation" shall remain with the compensation of $2,600.00 per month. Total <br />compensation under the extended term of the Agreement shall not exceed $2,600.00. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full <br />force and effect. <br />
