PWA 0)/Rmay Ly <br />NON-EXCLUSIVE LICENSE AGREEMENT <br />THIS LICENSE AGREEMENT ("Agreement') is made and entered into on 1)1244 3 <br />by and between the City of Santa Ana (the "LICENSOR") and Habitat for Hum nity of <br />Orange County, ("LICENSEE") with respect to the following: <br />1. ACKNOWLEDGEMENTS <br />A. LICENSOR owns the vacant lot identified as APN 011-065-19 thru APN 011-065- <br />24, located at the northeast corner of McFadden Avenue and Orange Avenue in <br />Santa Ana, California (the "License Area"). <br />B. LICENSEE represents that it desires to utilize the License Area for participant <br />parking for a one day "Leaders Stepping Up for Habitat" home build event (the <br />"Project") near the License Area. <br />C. LICENSOR desires to license use of said License Area to LICENSEE on the <br />terms and conditions set forth below. <br />2. GRANT OF LICENSE <br />a. LICENSOR grants to LICENSEE a personal, non-exclusive, revocable license <br />("License") for two days, April 17, 2013 through April 18, 2013, from 7:00 a.m. to <br />5:00 p.m. each day, to encroach upon the License Area as hereinabove <br />described and shown in Exhibit "A", attached hereto and incorporated by this <br />reference. to allow: <br />1) April 17, 2013 — entry to prepare the lot for parking during the Project. <br />Said preparation may include removing weeds, raking to eliminate <br />rocks and weeds, and disposal of rocks and weeds off-site. No <br />chemicals shall be used to remove weeds. <br />2) April 18, 2013 -participant parking for the Project. <br />b. LICENSEE may not encroach upon the License Area for any other purpose or <br />business without obtaining LICENSOR's prior written consent. <br />c. LICENSOR shall not be responsible for loss of or damage to, any personal <br />property left on the License Area, or improvement made by LICENSEE in the <br />License Area. <br />d. This License is made subject and subordinate to the prior and continuing right of <br />LICENSOR to use the property or the use of the public right of way. <br />3. DUTIES OF LICENSEE <br />a. In exercising these rights, LICENSEE shall use reasonable care and may not <br />unreasonably increase the burden on the License Area. LICENSEE agrees that <br />any use it makes of the License Area as specified herein shall be affected with all <br />
