H R-2013-01-RMS. <br />March 7, 2013 <br />Page 5 <br />Based on the analysis above, it is recommended that the Historic Resources Commission adapt a <br />resolution to deny the proposed removal of the Maharajah House from the Santa Ana Register of <br />Historical Properties. <br />CEQA Compliance <br />In accordance with the California Environmental Quality Act, the proposed project has been determined <br />to be a Statutory Exemption per Section 15270 as CEQA does not apply when a public agency rejects <br />or disapproves a project. Should the Commission wish to approve this action and remove this property <br />from the Santa Ana Register of Historical Properties, the Commission would have to find that the <br />original findings were in error, and that the subject site does not meet the criteria for being placed on <br />the city register of historical properties.
