City Atty. <br />DATE 9/7/79 PHONE <br />834 -4900 <br />SUBJECT AMENDMENT OF CABLE TV FRANCHISE <br />PROCEDURES. <br />APPHOV� <br />DEPA RiMEN HEAD DEPl1TY CITY MANAGER <br />RECOMMENDED ACTION : Adoption <br />DATE OF COl)NCII_ ACTION 71 !!1 <br />A <br />ASSISTANT CITY MANAGER RK GF THE C UNCI L <br />BACKGROUND: At its August 20 meeting, the City Council directed the City <br />Attorney to prepare an amendment to the Cable TV franchise application <br />procedures in the Municipal Code, to establish a competitive Request for <br />Proposals format with consultant costs to be covered by application fees. <br />This ordinance is submitted in response to that direction. <br />ANALYSIS: The amendment limits the filing franchise applications to a <br />period set by the Council for responses to a Request for Proposals. It <br />authorizes the Council to set the fee at the time the Request for Proposals <br />is issued. <br />The City Charter requires a franchise grant of this type to <br />be in the form of an ordinance, and requires a public hearing on any proposed <br />franchise grant to a specific grantee. The procedures established by this <br />amendment, therefore, are designed to select a "proposed grantee" from among <br />the various cable TV companies who submit proposals. The Charter - mandated <br />ordinance and hearing will then be directed to the "proposed grantee." Of <br />course, the Council will be free to hold public hearings during the process <br />of selecting a "proposed grantee" if it wishes to do so. <br />SELECTION OF A CONSULTANT: Following adoption of this amendment, staff <br />will proceed to make inquiries of professional consultants for the purpose <br />of drafting Requests for Proposals and evaluating applicants. Two California - <br />based firms, Alta California Services, Inc. and Telecommunications Management <br />Corp., have served as consultants to the cities of Anaheim and Orange respectively <br />and both are highly recommended by staff members in those cities. Other <br />firms may also be considered, but staff feels we should restrict selection <br />of a consultant to California -based firms in order to promote accessibility. <br />Unless the Council prefers otherwise, staff will proceed ahead to prepare a <br />draft consultant agreement with the firm it feels can best serve the City's <br />needs.
