VP URARCE.ON HLE <br />itaORdt MY E"RWEED <br />UNINU, if URANCE EXP :.S <br />_ �_cp-13 o- <br />14— <br />CLERK OFAWCIL <br />DATE: <br />N-2013-069 <br />SAP D (3\ AGREEMENT FOR EVALUATION OF MOBILE COMPUTER EQUIPMENT <br />?_Cg <br />,i i 8 JYZw+ltil <br />t1,'OUTOUYI <br />THIS EQUIPMENT EVALUATION AGREEMENT is entered into ono_3rd, 2013 <br />by and between DuraTech USA, Inc., a California corporation (hereinafter "DuraTech") <br />and the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California (hereinafter "City"). <br />RECITALS <br />WHEREAS, the City desires to evaluate and test in real world situations mobile computer <br />equipment in police patrol vehicles prior to putting out a Request for Proposals ("RFP") <br />for mobile computer equipment. <br />WHEREAS, DuraTech is willing to allow the City to use its mobile computer equipment <br />in a police patrol vehicle for testing and evaluation for marketing purposes. <br />THEREFORE, in consideration of the foregoing premises, mutual covenants and <br />agreements contained herein, and other good and valuable consideration, receipt of which <br />is acknowledged, the parties hereto agree as follows: <br />1. EQUIPMENT <br />DuraTech hereby grants the City the use of the following "equipment" for evaluation and <br />testing purposes: <br />• Motion Computing F5t rugged computer tablet (Model #CFT-003) <br />• Motion Computing Desktop Docking station for F5t tablet (Model <br />#TCD001) <br />• Motion Computing Locking Mobile Dock <br />• Man & Machine "So Cool" keyboard <br />2. INSTALLATION <br />A. The Equipment will be installed into one (1) City police vehicle. The <br />precise vehicle will be determined by the Chief of Police or his designee. DuraTech will <br />endeavor to schedule the installation of the Equipment within fourteen (14) days of the <br />effective date of this Agreement. <br />B. The installation will be performed by DuraTech's sub -contractor <br />Computer Deductions Inc. (hereinafter referred to as "CDI") located at 1400 East <br />Wilshire Ave., Santa Ana, CA 92705. The installation will be performed at CDI's <br />facility. CDI was selected by DuraTech for installation of the equipment. in City's <br />vehicle and removal thereof after the evaluation and testing period. DuraTech agrees to <br />bear the responsibility for any damages which occur as a result of CDI's installation or <br />
