ROH - 11/26/12 <br />RESOLUTION NO. 2012-15 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA RESCINDING PLANNING <br />COMMISSION RESOLUTION NO. 89-7 WHICH <br />DELEGATED AUTHORITY TO THE ZONING <br />ADMINISTRATOR TO ACT ON ALCOHOL SALES <br />CONDITIONAL USE PERMITS <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Section 41-630(b) of the SAMC allows the Planning Commission to <br />delegate certain duties to the Zoning Administrator. <br />B. In 1989 the Planning Commission delegated authority to the Zoning <br />Administrator to grant Conditional Use Permits for alcohol sales licenses. <br />Over the years this has caused delays for applicants who have had to <br />have subsequent meetings before the Planning Commission, as well as <br />confusion in those cases where an alcohol license CUP is proposed in <br />conjunction with a banquet or after-hours CUP, which are heard by the <br />Planning Commission. <br />C. Rescission of Planning Commission Resolution No. 89-7 came before the <br />Planning Commission of the City of Santa Ana for a duly noticed public <br />hearing on November 26, 2012. <br />E. Pursuant to the California Environmental Quality Act ("CEQA") and the <br />State CEQA Guidelines, the adoption of this resolution is exempt from <br />CEQA review, and a Notice of Exemption will be filed upon adoption of <br />this resolution. <br />Section 3. The Planning Commission of the City of Santa Ana, after <br />conducting the public hearing, hereby rescinds Planning Commission Resolution No. <br />89-7, thereby removing the authority to grant alcohol license CUP's from the Zoning <br />Administrator and returning that responsibility to the Planning Commission. This <br />decision is based upon the evidence submitted at the above said hearing, which <br />includes, but is not limited to: the Request for Planning Commission Action dated <br />November 26, 2012, and exhibits attached thereto; and the public testimony, all of <br />which are incorporated herein by this reference. <br />Resolution No. 2012-15 <br />Page 1 of 2 <br />75A-13
