K. Drug Free Workplace. Operator certifies that it has established the <br />following drug -free workplace policy: <br />1. The unlawful manufacture, distribution, dispensing, possession or use <br />of a controlled substance is prohibited in the workplace for any employee. <br />2. The employees of Operator will be required to: <br />a) Abide by the terms above in statement 1. <br />b) Notify appropriate officials of the City of any criminal drug <br />statute conviction for a violation occurring in the workplace not later than <br />five days after such conviction. <br />c) Within 30 days of receiving such notice, appropriate personnel <br />action will be taken by Operator against such employee, up to and <br />including termination. <br />36. ATTACHMENTS TO AGREEMENT <br />This Agreement includes the following, which are attached hereto and made a <br />part hereof: <br />Exhibit A — RFP 12 -060: Parking Operations and Management Services <br />Exhibit B — Operator's Proposal <br />Exhibit C — Additional hisured Endorsement <br />32 <br />
