AMENDMENT TO AGREEMENT <br />FOR ON-CALL SERVICES <br />THIS AMENDMENT TO AGREEMENT is entered into on August 5, 2013, by and <br />between Doty Brothers Equipment Company dba Doty Brothers Construction Company <br />("Contractor"), and the City of Santa Ana ("City"). <br />RECITALS: <br />A. The parties entered into that certain Agreement A-2008-213, dated August 18, 2008, <br />(hereinafter "said Agreement") by which Contractor has provided on-call emergency water <br />and sewer services. <br />B. Said Agreement has previously been amended to extend the term and revise the fee schedule. <br />C. In accordance with the terms and conditions of said Agreement, the parties wish to extend the <br />term of said Agreement, revise the applicable fee schedule and increase compensation to <br />provide funding for on-call services during the extended term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this Amendment to <br />Agreement, the parties agree as follows: <br />Section 2.a, TERM OF AGREEMENT, shall be amended to extend the term for an additional <br />one-year period, through August 31, 2014. <br />2. Section 6.a., COMPENSATION AND PAYMENT, shall be amended to increase <br />compensation to make available a maximum amount of $150,000 to pay for on-call <br />emergency water and sewer services provided during the extended term from September 1, <br />2013 through August 31, 2014. <br />3. Pursuant to Section 6.b., COMPENSATION AND PAYMENT, commencing September 1, <br />2013, City agrees to pay and Contractor shall provide services at the rates and charges set <br />forth in Exhibit B-1, attached hereto. <br />4. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br /> <br /> <br /> <br />EXHIBIT 1 <br />25G-3
