"Councilmember Sarmiento reported that out of an abundance of caution and due to <br />any potential nexus with business clients would be recusing self from Agenda Item 75A; <br />he left the dais and did not return to the meeting. <br />PUBLIC HEARINGS <br />75A PUBLIC HEARING - ORDINANCE REGULATING ALCOHOL SALES <br />AND ENTERTAINMENT - MODIFICATIONS TO CHAPTER 41 & 11 OF <br />SAMC (ZOA NO. 2012-03) - Planning and Building Agency <br />Recommended action approved by Planning Commission on November <br />26, 2012, by a vote of 4-2 (Alderete, Yrarrazaval opposed). <br />Item continued from the December 3, 2012 Council meeting per staff <br />request by a vote of 7-0; <br />Continued from the February 4, 2013 Council meeting per direction from <br />the Public Safety Council Committee; <br />Council continued per staff's request to a minimum of 90 days on March 4, <br />2013. <br />Legal Notice published in the Orange County Reporter on July 5, 2013. <br />Executive Director of Planning and Building, Jay Trevino presented staff <br />report. Listed process and extensive number of meetings held on the <br />subject. <br />Written communication received and entered into the record. <br />Mayor Pulido opened the Public Hearing. <br />The following speakers addressed the Council: <br />• Omero Guerrero, spoke in support of proposed ordinance. <br />• George Mendoza, spoke in support of ordinance; provisions of <br />ordinance would allow patrons to enjoy the City after hours. <br />• Allen Moon, advocate for vibrant cultural components, supports <br />ordinance that aligns with branding of City. <br />• Sara Escalante, representing the Santa Ana Business Council, <br />concerned that Police Department not able to handle after hour calls <br />and vandalism; concerned about distance between establishments <br />allowed to operate; does not support ordinance. <br />• James Kendricks, supports ordinance, businesses will be given <br />another tool to promote their business - become destination City. <br />• Jonathan Pantoja, spoke in opposition of ordinance. <br />• Tixoc Ventura, spoke in opposition to ordinance; other recreational <br />activities should be promoted. <br />CITY COUNCIL MINUTES 12 JULY 15, 2013
