<br /> <br /> <br /> <br /> <br /> SECOND AMENDMENT TO AGREEMENT <br /> <br /> <br /> THIS SECOND AMENDMENT TO AGREEMENT is entered into on September 3, 2013, by and <br /> between Naranjo Landscape, Inc., a California corporation (hereinafter "Consultant") and the City of <br /> Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and <br /> laws of the State of California (hereinafter "City"). <br /> <br /> <br /> RECITALS: <br /> A. The parties entered into Agreement #A-2011-229, dated October 3, 2011, (hereinafter "said <br /> Agreement") by which Consultant has provided weed and debris removal services. <br /> <br /> B. The City exercised its first option to extend on September 4, 2012. <br /> <br /> C. In accordance with the terms and conditions of said Agreement, the City wishes to exercise the <br /> second option to extend and increase compensation to pay for services during extended term. <br /> <br /> WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the <br /> terms and conditions of said Agreement, except those amended in this Second Amendment to Agreement, <br /> the parties agree as follows: <br /> <br /> <br /> 1. Section 2, COMPENSATION, shall be amended to increase compensation to an amount not to <br /> exceed $190,000.00, to pay for weed and debris removal services during the term from September 1, <br /> 2013 through August 31, 2014. <br /> <br /> <br /> 2. Section 3, TERM, shall be extended for an additional one-year period, through August 31, 2014. <br /> The term of this Agreement may be extended for an additional one-year term at the City's option, <br /> evidenced by a writing executed by the City Manager and the City Attorney. <br /> <br /> 3.
