SECOND AMENDMENT TO AGREEMENT THIS SECOND AMENDMENT TO AGREEMENT is entered into on September 3, 2013, by and between Naranjo Landscape, Inc., a California corporation (hereinafter "Consultant") and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). RECITALS: A. The parties entered into Agreement #A-2011-229, dated October 3, 2011, (hereinafter "said Agreement") by which Consultant has provided weed and debris removal services. B. The City exercised its first option to extend on September 4, 2012. C. In accordance with the terms and conditions of said Agreement, the City wishes to exercise the second option to extend and increase compensation to pay for services during extended term. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Second Amendment to Agreement, the parties agree as follows: 1. Section 2, COMPENSATION, shall be amended to increase compensation to an amount not to exceed $190,000.00, to pay for weed and debris removal services during the term from September 1, 2013 through August 31, 2014. 2. Section 3, TERM, shall be extended for an additional one-year period, through August 31, 2014. The term of this Agreement may be extended for an additional one-year term at the City's option, evidenced by a writing executed by the City Manager and the City Attorney. 3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect. 25B-3
