<br /> <br /> <br /> EXHIBIT 3 <br /> <br /> RESOLUTION NO. 2013- <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SANTA ANA CONFIRMING HOURS AND <br /> PARKING RATES FOR SPECIFIED CITY OWNED <br /> PARKING FACILITIES <br /> <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS <br /> FOLLOWS: <br /> Section 1. The City Council of the City of Santa Ana conclusively finds, determines <br /> and declares as follows: <br /> <br /> A. The City of Santa Ana owns four (4) parking garages and numerous parking lots <br /> throughout the City. ("Parking Facilities"). <br /> <br /> B. As owner of the Parking Facilities and pursuant to the California Vehicle Code and <br /> Section 36-431 of the Santa Ana Municipal Code, the City Council may by resolution establish <br /> parking rates and "fix and determine traffic patterns for the movement of traffic on municipally <br /> owned or operated parking lots and when the council regularly passes and adopts any <br /> resolution for any of said purposes the same shall control the use of the area affected thereby, <br /> and said regulations may be applied to lots open to public use or to lots restricted to certain <br /> classes of vehicles and to certain hours and days. <br /> <br /> C. The location of and rates for parking directly impact traffic and parking circulation <br /> patterns, traffic congestion and parking availability on a daily basis and during special events. <br /> <br /> D. Establishing and authorizing the City Manager to adjust parking rates as a means of <br /> regulating the use of all City parking facilities and resources will distribute the parking load more <br /> evenly between residents, and visitors, and maximize the utility and use of certain City parking <br /> facilities and resources, thereby making parking easier and convenient to customers and <br /> reducing traffic hazards and congestion, and promoting the public convenience, safety, and <br /> welfare. <br /> <br /> Section 2. The City of Santa Ana hereby establishes the following parking hours and <br /> rates for the Parking Facilities identified below: <br /> <br /> A. Third St. and Broadway (3 levels-440 spaces) <br /> Hours: Monday and Tuesday 8am to 8pm; Wednesday through Saturday 8:00 am to <br /> 12:00am; and Sunday 10:00am to 6:00pm. <br /> Day Rates: $1.00 per hour or any fraction thereof; first 30 minutes is $0.50 with a <br /> maximum of $7.00 per day. <br /> Evening Rates: A flat pre-pay rate of between $2.00 and $20.00 may be established <br /> with the approval of the City Manager. <br /> Monthly Parking Rate: $20.00-$60.00 depending on parking space location and per <br /> agreement, if applicable <br /> <br /> <br /> 55394.00000\8238300.1 55C-9 <br />
