Chapter 1 <br />Introduction and Overview <br />Overview <br />The City of Santa Ana (City), as the lead agency under the California Environmental Quality Act <br />(CEQA), has prepared this initial study (IS) and proposed mitigated negative declaration (MND) to <br />evaluate the potential environmental consequences associated with the Bat Nha Meditation Center <br />project. The proposed project consists of the demolition and replacement of existing buildings on <br />approximately 1.46 acres at 719 and 803 South Sullivan Street in the central portion of the City of <br />Santa Ana with a new Meditation Center. Implementation of the proposed project would require a <br />Conditional Use Permit (CUP) to allow a religious facility on a parcel with a Single-Family <br />Residential (R-1) zoning designation, variances to allow a reduction in parking and to exceed to <br />allowable building height, a voluntary lot merger to consolidate the two parcels of land, and <br />approval of the site plan. As part of the City's discretionary review process, the proposed project is <br />required to undergo an environmental review in accordance with the CEQA. <br />Authority <br />The preparation of all IS/MND is governed by two principal sets of documents: CEQA (Public <br />Resources Code Section 21000, et seq.) and the State CEQA Guidelines (California Code of <br />Regulations Section 15000, et seq.). Specifically, Section 15063 of the State CEQA Guidelines and <br />Sections 15070-15075 of Article 6 guide the process for the preparation of a negative declaration or <br />a mitigated negative declaration. Where appropriate and supportive to an understanding of the <br />issues, reference will be made either to the statute, the State CEQA Guidelines, or appropriate case <br />law. <br />This IS/MND, as required by CEQA, contains 1) a project description; 2) a description of the <br />environmental setting, potential environmental impacts, mitigation measures for any significant <br />effects, and consistency with plans and policies; and 3) names of preparers. <br />The mitigation measures included in this IS/MND are designed to reduce or eliminate the potentially <br />significant environmental impacts described herein. Where a mitigation measure described in this <br />document has been previously incorporated into the project, either as a specific feature of design or <br />as a mitigation measure, this is noted in the discussion. Mitigation measures are structured in <br />accordance with the criteria in Section 15370 of the State CEQA Guidelines. <br />Scope of the IS/MND <br />This 1S/MND evaluates the proposed project's effects on the following resource topics: <br />• aesthetics <br />• agriculture and forestry resources <br />The Bat Nha Meditation Center June 2013 <br />Initial Study/Mitigated Negative Declaration 1-1 IMF 00215.12 <br />31 C-37
