11.19 Equal Opportunity and Fair Housing. Developer shall carry out the <br />construction and perform its obligations under this Agreement in compliance with all of the state <br />and federal laws and regulations regarding equal opportunity and fair housing described in 24 <br />CFR 92.350. <br />11.20 Conflict of interest. Developer shall comply with and be bound by the conflict <br />of interest provisions set forth at 24 CFR 570.611, as well as state regulations pertaining to <br />conflict of interest. <br />I. 11.21 Uniform Administrative Requirements. Developer shall comply <br />with the requirements and standards of OMB Circular No. A-122, "Cost <br />Principles for Non-Profit Organizations," and with the following Attachments to <br />OMB Circular No. A-110: <br />a. Attachment A, "Cash Depositories", except for paragraph 4 concerning <br />deposit insurance; <br />b. Attachment B, 'Bonding and Insurance"; <br />C. Attachment C, "Retention and Custodial Requirements for Records", <br />except that in lieu of the provisions in paragraph 4, the retention period for <br />records pertaining to individual NSP activities starts from the date of <br />submission of the annual performance and evaluation report, as prescribed <br />in 24 CFR 570.507, in which the specific activity is reported on for the <br />final time; <br />d. Attachment F, "Standards for Financial Management Systems"; <br />e. Attachment H, "Monitoring and Reporting Program Performance", <br />Paragraph 2; <br />f Attachment O, "Procurement Standards." <br />11.22 Monitoring. Developer shall allow the City to conduct periodic inspections of <br />each of the assisted units on the Property as required by the Program after the date of <br />construction completion, with reasonable notice. Developer shall cure any defects or <br />deficiencies found by the City while conducting such inspections within two weeks of written <br />notice thereof, or such longer period as is reasonable within the sole discretion of the City. <br />11.23 Recertification of Tenant Income. <br />a. The HOME program guidelines and regulations will be used for the <br />recertification of Tenant Income for the Project. <br />b. Developer shall take all necessary steps to review the income of all tenants <br />prior to renting to them, as well as reviewing current tenants on an annual basis, in accordance <br />with HOME regulations and guidelines. Every fifth (5'h) year, Developer shall require new <br />original income documents to be submitted by tenants. Tenants in NSP assisted units whose <br />incomes no longer comply with federal income guidelines shall have their rents adjusted in <br />accordance with federal HOME guidelines (24 CFR 92.252-92.253). <br />23 <br />80A-79
