AMENDMENT TO DEVELOPMENT AGREEMENT NO. 2007-01. VESTING <br />TENTATIVE TRACT MAP N0.2013-04 AND SITE PLAN REVIEW NO. 2013-03 <br />Peter Zak, representing Lyon Community Development, is requesting approval to <br />amend provisions of the MacArthur Place South development agreement, a vesting <br />tentative tract map and a site plan review approval as well as an addendum to the <br />certified Environmental Impact Report in order to allow the construction of a new <br />multi-family residential development at 1901 East First Street located in the (C5) <br />zoning district. <br /> <br />PUBLISHED IN THE ORANGE COUNTY REPORTER: August 16, 2013 <br />PUBLICLY NOTICED: August 15, 2013 <br />RECOMMENDATION: <br />Planning Commission recommends that the City Council: <br />1. Adopt a resolution approving the Addendum to the Final Environmental Impact <br />Report No. 2006-01 and approve the Mitigation Monitoring and Reporting <br />Program. <br />2. Adopt an ordinance approving an amendment to Development Agreement No. <br />2007-01. <br />3. Adopt a resolution approving Vesting Tentative Tract Map No. 2013-04 as <br />conditioned. <br />4. Adopt a resolution approving Site Plan Review No. 2013-03 as conditioned. <br />Principal Planner Vince Fregoso presented the staff report and recommendation and <br />introduced the project architect, Christopher Coe, who discussed the project. <br /> <br />Vice Chair Mill confirmed the termination of the Park Center CC&Rs as of 2006 with <br />Assistant City Attorney Ryan Hodge. <br />Chairman Alderete asked for clarification of the east fire lane width; commented on <br />Sec 5.9 with regards to the inclusionary housing fee of $3,000 that is consistent with <br />other projects. <br />Planning Commission Minutes Page 2 of 7 <br />August 26, 2013 <br />
