9/20/13LES <br />RESOLUTION NO. 2013- <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING THE <br />APPLICATION FOR GRANT FUNDS FOR THE <br />URBAN GREENING GRANT PROGRAM UNDER <br />THE SAFE DRINKING WATER, WATER QUALITY <br />AND SUPPLY, FLOOD CONTROL, RIVER AND <br />COASTAL PROTECTION BOND ACT OF 2006 <br />(PROPOSITION 84) <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS <br />FOLLOWS: <br />Section 1: The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br />A. The California State Legislature and Governor of the State of California <br />have enacted Proposition 84 and provided funds for the program above, which provides <br />funds for urban greening programs. <br />B. The Strategic Growth Council has been delegated the responsibility for the <br />administration of the grant program and setting up necessary procedures governing the <br />program. <br />C. Said procedures established by the Strategic Growth Council require a <br />resolution certifying the approval of application by the City Council before submission of <br />said application to the State. <br />D. If chosen, the City will enter into an agreement with the State of California <br />to carry out the urban greening of Center Street at Jerome Park (the "Project'). <br />Section 2: The City Council understands the assurances and certifications in the <br />application and hereby approves the filing of an application for "Proposition 84" urban <br />greening grant program funds and certifies that the City has or will have sufficient funds <br />to operate and maintain the Project or will secure the resources to do so. <br />Section 3: The City Council hereby certifies that it will comply with the provisions <br />of section 1771.5 of the California Labor Code regarding payment of prevailing wages on <br />projects awarded Proposition 84 funds. <br />Section 4: The City Council hereby certifies that, if applicable, the Project will <br />comply with any laws and regulations, including but not limited to, legal requirements for <br />building codes, health and safety codes, disabled access laws, environmental laws, and <br />that prior to commencement of construction, all applicable permits will have been obtained. <br />Resolution No. <br />55A-5 Page 1 of 3
