from the bank described in Subsection A of this Section, provided that said <br />employee first gains approval for said use by the executive board of the <br />Association in the manner specified by its rules as adopted from time to time, and <br />subject to the approval or disapproval of the Police Chief consistent with the <br />operational needs of the Police Department. <br />C. No withdrawal or use of such bank may be made by or on behalf of an employee <br />ordered to take time off without pay for discipline imposed by the Police Chief or <br />his designee. <br />D. The City agrees that effective January 1, 2014, it will provide the SAPOA with a <br />quarterly accounting of all Association Comp Time accrued and used. <br />10. Joint Labor Management Study of Salary Schedule <br />4.14 Joint Labor Management Study - Salary Schedule. <br />The parties agree that at any time during the term of this MOU either the City or the <br />Association may ask the other party to meet and negotiate over the implementation of a <br />new salary schedule. <br />11. Court Appearance Pay <br />8.13 Court Appearance. Compensation for court appearance by personnel covered by this <br />Agreement shall be as follows: <br />A. For each required court appearance made by an employee during his or her off- <br />duty time in regard to City business, employees shall be paid overtime for the <br />period of time from their arrival at court until they are released from court or the <br />court session closes for that day. However, in no case, shall an employee receive <br />less than two (2) hours overtime for a court appearance. If court appearances are <br />made both in the morning and afternoon of a particular day, two (2) hours <br />overtime will be allowed for each session attended. If the employee is not <br />released and must remain available for afternoon court, the employee shall be <br />paid overtime for all hours the court is in session that day. <br />The employee must provide a copy of the subpoena requiring his or her <br />attendance to initiate payroll procedures. <br />B. A subpoenaed employee scheduled to appear in court on City business during off- <br />duty time may be placed on stand-by status by the Police Chief or his authorized <br />representative if the employee can respond to the court, if called, within 60 <br />minutes of the employee's notification. In the event such off-duty employee is on <br />stand-by status during any court session and is not required to appear in court, <br />such employees shall be compensated two (2) hours on a straight time basis, for <br />each court session.
